on this ____ day of________, personally appeared before me, _________ of the __________, a court of record within and for the County and State aforesaid, Abram Hartsel, aged 63 years, a resident of the town of Rheatown county of Greene State of Tennessee , who being duly sworn according to law, declares that he is the identical Abram Hartsel who was Enrolled on the 19 day of Sept 1864 in Company F of the 56 Regiment of Pa Vols. Commanded by G. T. Michaels and who was honorably Discharged at Washington D.C. on the 31 day of May, 1865; that his personal description is as follows: Age, 63 years; height 5 feet 9 inches; complexion dark; hair dark; eyes hazel. That while a member of the organization aforesaid, in the service and in the line of his duty at Wilson�s Station, in the State of Va. On or about the _______ day of April, 1865 he contracted chronic diarrhea and partial loss of sight, through cold and exposure harding marching and _____from which has suffered ever since, being greatly incapacitated for the performance of manual labor on account of same.

That he was treated in hospitals as follows: ___________________________
That he has not been employed in the military or naval service otherwise than as stated above___________
That he has not been in the military or naval service of the United States since the 31 day of May 1865. That since leaving the service this applicant has resided in the Town of Rheatown in the State of Tenn., and that his occupation has been that of a Mason. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a Mason. That he is now greatly disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States, and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. He hereby appoints with full power of substitution and revocation, M. V. TIERNEY, OF WASHINGTON, D.C. his true and lawful attorney to prosecute his claim. That he has never received nor applied for a pension; that his place of residence is Rheatown Greene Co Tenn. and postoffice address is Rheatown Greene Co. Tenn.

ARTICLES OF AGREEMENT
Whereas I, Abraham Hartsel Company F of the 56 Regiment of Pa Volunteers, war of __________, having made application for pension under the laws of the United states:
NOW THIS AGREEMENT WITNESSETH: That for and in consideration of services done and to be done in the premises, I hereby agree to allow my agent, M. V. TIERNEY, of Washington, D.C., the fee of TWENTY-FIVE dollars, which shall include all amounts to be paid for any services in the furtherance of said claim; and said fee shall not be demanded by or payable to my said agent, in whole or in part, except in case of the granting of my pension by the Commissioner of Pensions; and that the same shall be paid to him in accordance with the provisions of sections 4768 and 4769 of the Revised Statues, U.S.

SIR: I have the honor to request that you will furnish from the records of the War Department a full report as to the service, disability, and hospital treatment of Abraham Hartsell , who, it is claimed, enlisted September 19, 1864 and served as private in Co. F, 56 Reg�t Pa Vol Inftry and was discharged at Washington D C May 31, 1865. While serving in Co. F, 56 Reg�t Pa Vol Inftry he was disabled by Chronic Diarrhea, and partial loss of sight results of cold and exposure about April 1865 at Wilson�s Station, Va. And was treated in hospitals of which the names, location and dates of treatment are as follows: None alleged. Please search regimental hospital records.

Volunteers, was Drafted on the 19 day of Sept, 1864 , at Chambersburg for 1 Year , and is reported: on rolls to April 30/65 present Mustered out with Detachment near Washington D.C. May 31, 1865 as Private Regtl Hospital Records show him treated May 14 to 17 also 20 to 22 (inclu). 1865 for Acute Dysentery. The records of this office furnish no further evidence of disability.

We hereby certify that in compliance with the requirements of the law we have carefully examined this applicant, who states that he is suffering from the following disability, incurred in the service, viz: Chronic Diarrhea and partial loss of sight

Pulse rate per minute, 79 ; respiration, 19; temperature 98 � ; height 5 feet 9 inches; weight 139 pounds; age 63 years
He makes the following statement upon which he bases his claim for Original Claimant states he contracted the above disabilities during the Va campaign and has been having diarrhea ever since and the last five years it has been going much worse - not able to perform any manual labor. Many times can�t see to read out of left eye and has been so ever since discharge.

Upon examination we find the following objective conditions: We find tongue red and coated. Stomach very much contracted and tender also throughout the epigastri region. Liver tender and some what enlarged. Bowels distended and tender. Rectum red and congested and has 3 or 4 internal piles size hazle nuts. Congested but not bleeding or ulcerated. But they ????? very easily protended becoming external. He is rather emaciated and debilitated. We find he reads at 18 in No. 2.2.5 Snellen List Type but we see no marked opacity or structural lesion of eyes.

All other organs normal. We think he is 6/18 disabled for the performance of manual labor.

From the existing condition and the history of this claimant, as stated by himself, it is, in our judgment, _______ probable that the disability was incurred in the service as he claims, and that it has not been prolonged or aggravated by vicious habits. He is, in our opinion, entitled to a 6/18 rating for the disability caused by Chro Diarrhea and results for that caused by ______________.

In the matter of Original Invalid Pension No 676817 of A. Hartsel
ON THIS 20th day of July A.D. 1889, personally appeared before me, a Justice of the Peace in and for the aforesaid county, duly authorized to administer oaths T. R. Fetter aged 46 years, a resident of Leesburg in the county of Washington and state of Tennessee whose post office address is Leesburg and Lewis Ling aged 71 years, a resident of Telford in the county of Washington and State of Tennessee whose post office address is Telford well known to me to be reputable and entitled to credit, and who, being duly sworn, declares each for himself, in relation to aforesaid case, as follows:
We saw the above named claimant shortly after his discharge and return home from the army. His complexion was swarthy and sallow much reduced in flesh and looked like a man who had lost his health. We know from personal knowledge that he was suffering from chronic diarrhea for the last five years but have heard him state that he had it ever since he came home from the army. He has been suffering very much with cramps and pains in his bowels for the last three months and this spring was very much exhausted especially after evacuations so much so that he had to lie down and rest. Now in regard to the time lost by said claimant, we suppose he lost one half of his time and then he could not do anything like one half the work that he used to do when in health. Our reason for knowing said facts are derived from living near him, seeing him every year or oftener, hearing him complain, and seeing him in much pain as stated above.

We further declare that we have no interest in said case and are not concerned in its prosecution.

ON THIS 31 day of Jan 1890, personally appeared before me, a Justice of the Peace in and for the aforesaid county, duly authorized to administer oaths Gilbert Parker aged 46 years, a resident of Jockey in the county of Greene and State of Tennessee whose post office address is Jockey well known to me to be reputable and entitled to credit, and who, being duly sworn, declares each for himself, in relation to aforesaid case, as follows:

That he is acquainted with Abraham Hartsell and has been ever since the year 1871. That he worked with the said A. Hartsell at his trade in the year 1871 and more or less every year up to the present time. That he said A. Hartsell was suffering from Diarrhea. That he looked pale swathy and sickly. That his evacuations were very often some days worse than others. That he has heard him complain of Rheumatism often and that he complain of cramp in his stomach and bowels. At times he was so bad that I did not think he could live his disease is gradually growing worse every year. That he is not able to do more than � hands work. That he could not do more than 2/3 days work when at his best and some times not able to do anything. Said ???? has existed each and every year since the year 1871. That his reason for knowing said facts are derived from his working with him every year and hearing him complain and seeing him in much pain.

He further declare that he has no interest in said case and is not concerned in its prosecution.

When did you first see claimant after he returned from the army, and how do you fix the date? Answer: About the 22nd of June 1865. He arrived home on the 8th of June and I am confident I saw him 2 weeks afterward.
Of what disability did he complain, and how was he affected? Answer: Of chronic diarrhea. His complexion was dark with a yellowish tinge, was much reduced in flesh and looked as if he had lost his health.
How frequently have you seen him since your first acquaintance? Answer: From 1865 to 1870 6 or 8 times a year. From 1870 to 1890 2 times a year.
If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled for manual labor thereby during each year? Answer: Yes! His former vigorous constitution was gone and he had to resort to an easier and less profitable occupation to make a living, his former trade being a stone mason. I could not tell exactly each year. Some years more and others less, but as a whole I suppose one half his time.
My means of knowing the facts of the case are these: We were both drafted into the U.S. Service at the same time which would naturally have a sympathy for each other. Next we arrived from the same Township and County and state the same year and at no time lived more than 10 miles apart at any time.

When did you first see claimant after he returned from the army, and how do you fix the date? Answer: I saw the claimant to best of my knowledge the 12 of June 1865.
Of what disability did he complain, and how was he affected? Answer: Of chronic diarrhea. He complained of cron diarrhea and he suffered very much with cramps and pain in his bowels.
How frequently have you seen him since your first acquaintance? Answer: I saw him every year
If he has continued to suffer with such disability, please describe the symptoms which were apparent to you, and state to what extent he has been disabled for manual labor thereby during each year? Answer: he suffered with cramps and pains in his bowels in regard to time lost to the best of my knowledge he lost one half of his time.
My means of knowing the facts of the case are these: my means of knowing said facts are by living near him. Also working with him and seeing him every year.

ON THIS 18 day of February, 1890, personally appeared before me, a Clerk Common Pleas Court in and for the aforesaid County, duly authorized to administer oaths, William B. Hartzell, aged 54 years, a resident of Bedford Twp in the county of Bedford and State of Pennsylvania whose Post-Office address is Bedford, Bedford County Pennsylvania and John C Ling, aged 62 years, a resident of Bedford Twp in the County of Bedford and state of Pennsylvania whose post-office address is Bedford Bedford County Pennsylvania, well known to me to be reputable and entitled to credit, and who, being duly sworn, declare in relation to aforesaid case as follows:
I W. B. Hartzell, ????????? of claimant, was well and personally acquainted with Abraham Hartzell before he went into the U. S. Army. To the best of my knowledge he appeared free from chronic diarrhea. I saw him to the best of my knowledge one week after he got home from the army. He was sick looking very bad. His sickness seemed to continue till the year of 1870.

John C. Ling respectfully says that he was well acquainted with the claimant before the war. He was to the best of my knowledge he was sound and free from chronic diarrhea. I saw claimant when he came home. I think it was in 1865. He was sick and looking very pail and bad. Could not eat any thing of any account. Seemed to be all out of fix and continued to complain till he went to Tennessee.
We further declare that we have no interest in said case and are not concerned in its prosecution.

Slonaker aged 37 years, a resident of Telford in the county of Washington and State of Tennessee whose post office address is Telford well known to me to be reputable and entitled to credit, and who, being duly sworn, declares each for himself, in relation to aforesaid case, as follows:

I have known the said Abram Hartsel since 1871 lived in the house with him the winter of �71 or rather roomed in the house he was living in I was going to school. At times he complained of Chronic Diarrhea and at times was disabled from work. From my observation he was a daily sufferer. Have known him ever since lived at times within four miles of him. Live now 10 or 12 miles of him.

I further declare that I have no interest in said case and am not concerned in its prosecution.

In the matter of Abraham Hartzell Personally came before me a Clerk of Common Pleas Court in and for aforesaid County and State, Jonathan Dibert, aged 57 years citizen of the township of Bedford , County of Bedford, State of Pennsylvania, well known to me to be reputable and entitled to credit, and who, being duly sworn, declare in relation to aforesaid case, as follows:
Say that he was well and personally acquainted the claimant before he went into the U.S. Army and to the best of my knowledge he was free from chronic diarrhea. To the best of my knowledge I saw him the first or second day after he got home As soon as I heard he was sick I went down to see him. I found him sick in bed complaining of having diarrhea. After he got out of bed he lingered around a great deal for weeks and from that time in 1865 to the fall 1870 till he went south,. he never was the same man.

I further declare that I have no interest in said case and is not concerned in its prosecution.

ON THIS 2nd day of January A.D. one thousand eight hundred and 91 personally appeared before me, a County Court Clerk within and for the County and State aforesaid, Abraham Hartzell aged 65 years, a resident of Rheatown County of Greene State of Tennessee who, being duly sworn according to law, declares that he is a pensioner of the United States, enrolled at the Knoxville Pension Agency, at the rate of Six dollars per month, Certificate No. 510202, by reason of disability from Chronic Diarrhea, and resulting disease of rectum incurred in the Military service of the United States, while serving as a Private Co. F, 56 Regt Pennsylvania Vols. Inf. That he believes himself to be entitled to an increase of pension on account of the low rating granted him and on account of the very greatly increased disability from chronic diarrhea and diseased rectum and piles, and resulting disease of liver and stomach and heart. That he is almost wholly incapacitated for doing manual labor. That he has not had the benefit of a medical examination by a Medical Board of the Pension Bureau Since in February 1889 Almost two years ago. That his rate of pension is not proportionate to the degree of his disability. that he hereby appoints, with full power of substitution and revocation, W. E. F. We hereby certify that in compliance with the requirements of the law we have carefully examined this applicant who states that he is suffering from the following disability, incurred in the service, viz: Chr. Diarrhea, Dis Rectum and piles and that he receives a pension of Six dollars per month.
He makes the following statement upon which he bases his claim for Increase

Upon examination we find the following objective conditions: Pulse rate, 100; respiration 24, temperature 98 � ; height, 5 feet 10 � inches; weight, 138 pounds; age, 66 years.
I Chr. Diarrhea, Tongue red, no distension of stomach but tender, apparently no change in ??? of liver but dullness over stomach and bowels doughy
II Dis. Rectum. Rectum prolapsed � in ???? ????? vessel and livid and engorged
III Piles. Two internal piles, � in each in diameter, no ulceration, Heart irritable(?) but no change in area or ???, no murmur.
No other disability is found to exist.

He is, in our opinion, entitled to a 4/18 rating for the disability caused by Chr. Diarhrea, 4/18 for that caused by Dis Rectum, and 2/18 for that caused by piles, 2/18 Irritable Heart.

WHEREAS Abraham Hartsel late a _________(rank) in Company F, of the 56 Regiment of Pa. Vet Volunteers, war of the rebellion having made application for pension under the Act of Congress approved June 27, 1890.
    Now this agreement witnesseth: That for and in consideration of services done and to be done in the premesis, I hereby agree to allow my attorney, M. V. Tierney of Washington, D.C. the fee of TEN DOLLARS, which shall include all amounts to be paid for any services in the furtherance of said claim; and said fee shall not be demanded by or payable to my said attorney, in whole or in part, except in case of the granting of my pension by the Commissioner of Pensions; and that the same shall be paid to him in accordance with the provisions of Section 4 of the Act of June 27, 1890.

F 56 Regt Pennsylvania Vols in the war of the Rebellion who contracted Chronic Diarrhea as alleged in his orginal application for pension - That he died of Chronic Diarrhea on the 28 day of August A.D. 1892 who bore at the time of his death the rank of citizen in Greene Co. Tenn that she was married under the name of Mary Dibert to said Abirham Hartsel on the 19 day of December A.D. 1850 by Fredrick Benadick at Bedford Co. Pen there being no legal barrier to such marriage; that neither she nor her husband had been previously married. that she has to present date remained his widow; that the following are the names and dates of birth of al his legitimate children yet surviving who were under sixteen years of age at father's death, viz: no children under sixteen years of age at date of soldier's death. That she has not abandoned the support of any one of her children, but that they are still under her care or maintenance. That she has not in any manner engaged in or aided or abetted the rebellion in the United States; that she had no prior application has been filed But soldier was a pensioner Certf No. 510,202 that she hereby appoints, with full power of substitution and revocation, W. NOW THIS AGREEMENT WITNESSETH: That for and in consideration of services done and to be done in the premises, I hereby agree to allow my agent, W. E. F. Milburn of Greeneville, Tenn the fee of twenty five dollars, which shall include all amounts to be paid for any services in the furtherance of said claim; and said fee shall not be demanded by, or payable to my said agent, in whole or in part, except in case of the granting of my pension by the Commissioner of Pensions; and then the same shall be paid to her in accordance with the previsions of sections 4768 and 4769 of the Revised Statutes, U.S.

For the past fifteen years I have been personally acquainted with Abraham Hartsel having often heard him complain of being troubled with a diarrhea but did not examine and prescribe for him until about April 4th 1892. When I found him suffering with a severe diarrhea - complete intestinal indigestion and every evidence of an organic affection of the bowel doubtless caused by the Chronic Catarrh or chronic inflammation of the mucous membrane of the bowel. Mr. Hartsel�s disease was uncontrollable - he gradually grew weaker and died on the 28th of August from exhaustion.

Slonaker J.P. in and for the aforesaid County, duly authorized to administer oaths, Lewis Ling aged 74 years, a resident of Telford in the county of Washington and State of Tennessee whose Post-Office address is Telford Tenn also Sarah Stayer Sarah Stayer aged 49 years, a resident of Telford in the County of Washington and state of Tennessee whose post-office address is Telford, Tennessee well known to me to be reputable and entitled to credit, and who, being duly sworn, declare in relation to aforesaid case as follows:

I have known Abram Hartzell since a boy. We lived in the same neighborhood in Bedford Co. Pa. all our lives up to 1870 never more than two miles apart. We were boys together, ran about together and worked together. He was some younger than I. He never was married but once. His wife�s maiden name was Dibert. She also lived in the same neighborhood. Neither of them was ever married before. She yet remains the widow of A. Hartzell has not been married again. I don�t remember the year they were married but think it is between forty and fifty years.

I lived in sight of A. Hartzell�s house when I was a girl of some seven or eight years of age. Remember when they went to housekeeping. They were regarded as upright people. I have been to their house very often. Have known them ever since. Neither of them was ever married before as I ever heard or knew of. Mrs. Hartzell has not married since her husband died.

Personally came before me Jacob D. Fetter personally known to me to be a respectable citizen and a resident of Bedford Borough in the County of Bedford and state Pennsylvania and being duly sworn according law say that he has known Abraham Hartzel and Mary Dibert all their lifetime. They were raise in my neighborhood. I remember the time when it was taked that they were going to get married and soon afterward that they were married and was taken and reputed by all in that neighborhood as man and wife. They were looked upon regarded as respectable married people and they had a moderately large family of children, they took care of them and clothed and sent them to school as other people do. He live in my tenant(?) house three years. I have often heard him call her (Mary) his wife and Mary call him Abraham her husband. I know that they sold their house and small tract of land and moved to Tennessee.

I, Frank E. Colvin, being duly sworn say that I am Secretary of the Church Council of Trinity Lutheran Church of Bedford Pa. That I have in my charge and control the records and papers of said church, so far as the same are known to exist. I have examined said records and do not find any record of the marriage of Abraham Hartzell and Mary Dibert. That the records of said Church have been very much neglected and many of them are lost or destroyed. That the only record of marriages now known to exist extend back only until 1867. That diligent search has been made for the earlier records and they cannot be found. Affiant further states that he is in no way related to any of the parties above named and has no interest in the prosecution of said claim.

Personally came before me J. W. Lingenfelter a resident and citizen of the Borough of Bedford in the County of Bedford and state of Pennsylvania. Who being duly sworn according law declares and says that he was well acquainted with Abraham Hartzel and Mary Dibert who was afterward his wife. I did not see them married but soon after they were married they rented a house and went to housekeeping as man and wife and continued to live together as man and wife until they moved from their old neighborhood near Bedford Penn to their residence in Tennessee and yet the residence of the widow of Abraham Hartzel. They Abraham and Mary Hartzel were married at Bedford Penn in Dec. 19, 1850 until 1867 continued reside here when they moved to Tennessee. They were reputed and taken at all times to be husband and wife. Abram Hartzel frequently call Mary his in my presence. Said Hartzel employed me to ______ a deed for a piece of land he had sold and when he was ready to acknowledge he brought his wife to my office to join in the acknowledgement of the deed and it was signed them declaring themselves as husband and wife.

In the mater of the pension claim of Mary Hartzel of Rheaystown, Green County, Tennessee who was the wife of Abraham Hartzel for pension.

Abraham Imler who is well known to me as a respectable citizen of good repute for truth and varacity who being duly sworn declares and says in relation to said claim that he was well acquainted with Mary Hartzel the above claimant and her deceased husband Abram Hartzel. I frequently heard him call her his wife and she call her husband. They were taken and reputed to be husband and wife and lived together so such they moved from my neighborhood in Bedford County to Tennessee about 23 years ago. I bought their property he had a house and lot of about eight acres of land. I bought it from him and got his deed. Hartzel and his wife and myself went before a Justice of the Peace and they acknowledged the deed as husband and wife declaring it to their act and deed.

Personally came before me Isaac D. Earnest personally known to me to be a respectable and creditable citizen a resident of the Borough of Bedford in the County of Bedford and State of Pennsylvania and being sworn according to law declares and says that he was well acquainted with Abraham Hartzel and Mary Dibert afterward Mary Hartzel. He did not see them married. I know that they lived together as man and wife and had children born to them and that they were reputed to be husband. I sold Hartzel a small farm or tract they Hartzel and his wife lived upon this farm for a short time and sold to William Nycum. I know that afterward Nycum sold this little farm and moved Tennessee and is now somewhere in the western Country. I know the Abram Hartzel and Mary has moved with their family to Tennessee.

I Thomas Fetter solemnly swear that I knew Abraham Hartzel prior to the late War of the Rebellion and was intimately acquainted with him and have been with him at times until his death and never knew anything derogatory to his good character and was a man of temperate habits. I Lewis Ling solemnly swear that I knew the above Abraham Hartzel from his childhood and lived near him for years. I was with him a great deal, worked with me at times. I Thomas Fetter solemnly swear that I knew Abraham Hartzell prior to and since the war of the Rebellion. He was a man of temperate habits, of unblemished character. I lived near him in Pennsylvania. Saw him frequently. I know he was confined to his bed two weeks after he came home from the army. He complained of Diarrhea, partial loss of sight and heart disease at the time. I have known him all my life and never knew him guilty of any viciousness in living or indulging in anything to excess. I was not aided nor prompted by any person in making this affidavit.

I Lewis Ling solemnly swear that I worked with Abraham Hartzell before and since the late war. He was a stout man before the war. Since the war he was afflicted with chronic diarrhea and partial loss of sight and heart disease. I have known him often to stop in the midst of his work and answer to the calls of nature. He seemed to be exhausted after these calls. I was associated with him in work a great deal. I know of from personal knowledge that none of his disabilities were due to vicious habits. In making my affidavit I was not aided or prompted by any person.

Hartsell, aged 52 years, a resident of _________, County of Greene, State of Tenn, who, being duly sworn according to law, makes the following declaration in order to obtain reimbursement from the accrued pension for expenses paid (or obligation incurred) by claimant for the last sickness and for the burial of Mary Hartsell, who was a pensioner of the United States by certificate No. 380137, on account of the service of Abraham Hartsell in 56th Penn vol. On Mar 29 inst 1912, Mary Hartsell wife of Abram Hartsell, 56 Penn vol reg., died being a pensioner: from her last receipt of pension until her death there had accrued $21.50 which was hers and for which her daughter Mary A. Hartsell made application and filed with you all the affidavits asked for. The said Mary A. Hartsell filed two sets of affidavits the first about May 1912, the second about July 1912. These affidavits set forth that the said Mary A. Hartsell was the daughter of Mary Hartsell (Pensioner) and that the said Mary Hartsell (Pensioner) was helpless for two years prior to her death with Paralysis and that the daughter Mary A. Hartsell was the nurse in this sickness and that she had no means of support nor an inheritance. Please state why the matter has never been adjusted. Respectfully, G. H. Hartsell, J.P.

Sir:
In reply to your letter of October 22, 1913, concerning the claim of Mary A. Hartsell, for reimbursement in the case of Mary Hartsell, Certificate No. 380137, you are informed that said claim has been regarded by this Bureau as abandoned for the reason that no reply has been made to a call dated May 11, 1912, addressed to the claimant, for the evidence required to establish the claim. Such call was for itemized bills for medical attendance, nursing and care, undertaking, livery hire and cemetery charges. It is doubtful however whether the claim could be allowed, for the reason it is stated that the pensioner left real estate valued at from $1000 to $1200, which was probably sufficient to pay the expenses of her last sickness and burial. You seem to be under the impression that the accrued pension of a pensioner is a part of such pensioner�s estate; but such is not the fact. The law provides that accrued pension is not a part of a pensioner�s estate, is not liable for the debts of such estate, and does not pass to the pensioner�s heirs by inheritance. It can only be paid as reimbursement of the expenses of the pensioner�s last sickness and burial, and cannot be so paid if the pensioner left sufficient assets to meet such expenses. The claimant is at liberty to furnish the evidence indicated by the call of May 12, 1912 and such evidence if filed will be given consideration. Very respectfully, Commissioner.

Together with all and singular the buildings, improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders unto issues and profits thereof and all the estate right, title, interest, property claim and demand whatsoever of the Said parties of the first part in law equity or otherwise howsoever of in and to the same and every part thereof. Containing all two acres and one hundred and fifty-one perches and the usual allowance of ??? percentage being part of a large tract of land surveyed to John Frost the ninth day of May 1765 on warrant date the 31st of May 1762 the title to all of which said tract of land became vested in John Croyle Jr. who by his last will dated the 7th of December 1810 devised the same to John Croyle Jr party hereto to whom a patent issued from the Commonwealth dated the 16th day of January 1824 divided the 9th of March 1850 and the ???? Further with all and singular the buildings, improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders unto issues and profits thereof and all the estate, right, title, interest, property, claim and demand whatsoever of the Said party of the first part in law equally or otherwise heresoever of one and to the same and every part thereof . To have and to hold the Said above described piece of land, hereditaments, and premises hereby granted or mentioned and intended so to be, with the appurtenances and the said party of the second part his heirs and assigns to and for the only proper use and behoof of the said party of the Second part, his heirs and assigns forever. And the Said John Croyle Jr for himself, his heirs, executors and administrators doth by these presents covenant grant and agree to and with the Said Abrm Hartzell his heirs and assigns that he the said party of the first part and his heirs all and Singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said party of the second part his heirs and and assigns, against him the said party of the first part his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will well and truly warrant and forever defend. Whereas Abraham Koons late of Bedford Township made his last will and testament bearing date the second day of June A.D. eighteen hundred and thirteen and duly proved on the third day of July of the same year, and registered in will Book No 1 page 305 having left a widow and several children surviving him as well as certain real estate and personal property of which said children Eve afterwards intermarried with George Hartzell was one and whereas said Eve and George both died intestate leaving issue Abraham Hartzell and Rosanna now intermarried with Henry Reed who on the 10th day of Feby last for the consideration of five hundred and seventy four dollars released unto John Koons their interest under the will of said Abraham Koons which was intended as a full release of their respective interests in the estate of said Abraham Koonz - Now Know all men by these presents that one Abraham Hartzell and Rosanna Reed formerly Rosanna Hartzell and only children of Eve Hartzell formerly Eve Koonz who survived her husband George Hartzell for and in consideration of the payment of five hundred and seventy four dollars to us made by John Koons or by John Cessna for John Koons and for the further sum of one dollar to us now paid by John Cessna do hereby assign transfer and set over unto the said John Cessna his heirs and assigns forever all our respective rights titles, interests, claims and demands of the estate of the said Abraham Koons in right of our mother Eve deceased whether under the last will and testament of said Abraham Koons under the intestate laws of this commonwealth and whether real personal or mixed and whether due before or after the death of his widow. And we hereby forever release the real estate of the said Abraham Koons from any further payment on account of the same whether in the hands of said John Cessna or any person else. Witness our hands and seals the 26 day of Sept 1853.

This Indenture, made the first day of April A.D. one thousand eight hundred and fifty seven, Between Isaac Earnest and Catharine his wife of the Township of Bedford in the County of Bedford, State of Pennsylvania of the first part and Abraham Hartsel of the same Township of the second part, Witnesseth that the said parties of the first part for and in consideration of the sum of two thousand dollars to them in hand paid by the said party of the second part, the receipt of which is hereby acknowledge have granted, bargained and sold, released, conveyed and confirmed and by these presents do grant, bargain and sell, release, convey and confirm unto the said party of the second part his heirs and assigns all the following described real Estate, situate in Bedford Township, County and State aforesaid bounded and described as follows, viz: Beginning at a chestnut oak, thence by Henry Siffler north sixty three west forty three perches to a pine, north thirty two degrees east twenty one perches to a chestnut oak, north seventy one degrees west sixty five perches to stones, thence by David C. Straw to be left on the premises, Together with all and singular the buildings and improvements, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and to have and to hold the said premises unto the said party of the second part his heirs and assigns forever. And the said parties of the first part hereby covenant to warrant and defend the title to said premises as against them, heirs and assigns or any person claiming the same. Beginning at or near a pine thence North Sixty eight degrees East thirty Six perches to a post near Hickory, South Sixty two degrees West thirty Seven perches to post and thence North fourteen degrees West Six perches to the place of Beginning Containing about one hundred and ten perches. This Indenture, Made the First day of January A.D. one thousand eight hundred and seventy. Between Mary Hartzel and Abraham Hartzel her husband heirs of Christopher Dibert late of Bedford Township Bedford County and State of Pennsylvania, deceased of the township of Bedford in the County of Bedford, State of Pennsylvania, of the first part, and Jonathan Dibert of the same township County and State of the second part. Witnesseth, That whereas Christopher in his life time became legally seized in his demesne as of fee, of and into the hereinafter described Real Estate and being so there of seized having first made his last will and testament in writing, which will and testament in writing is dated the fifth day of November 1868, and was duly prooved and recorded in the Registers Office of Bedford County, in will book No 4, page 480, & C in which said Will it is provided (inter alia) the following: First, I give and bequeath unto my beloved wife Catharine Dibert all my Real Estate to be in her possession so long as she lives or remains my widow. And I will and bequeath to my son, Jonathan, all my Real Estate after the death of my wife Catharine, each heir chosing one appraiser to appraise the same, the said Jonathan to pay to each heir share and share alike to each heir of the valuation.

Now This Indenture Further Witnesseth, That the said parties of the first party in consideration of the sum of Four hundred dollars to them on hand paid by the said party of the second part, the receipt of which is hereby acknowledged have granted, bargained and sold, released, conveyed and confirmed, and by these presents do grant, bargain and sell, release, convey and confirm unto the said party of the second part, his heirs and assigns.

All the right title and interest whatsoever of the said Mary Hartzel and Abraham Hartzel her husband, of, in and to the following described Real Estate situate in the township County and State aforesaid, bounded and described as follows, Viz: Being the Farm and messuage of which Christopher Dibert, died seized containing about one hundred and thirty acres adjoining lands of George Dibert, John Shafer, ?????? and others.

Together with all and singular the buildings and improvements, rights, liberties privileges hereditaments and appurtenances whatsoever hereunto belonging or in anywise appertaining.

To Have and to hold, the said premises unto the said party of the second part his heirs and assigns forever.

And the said parties of the first part hereby covenant to warrant and defend the title to said premises, as against themselves their heirs and assigns, or any other person or persons claiming or to claim the same, or any part thereof.

Dibert and Elizabeth his wife, of the County of Bedford and State of Pennsylvania, Abram Hartzel and Mary E his wife of Washington County, Tennessee, Elizabeth Dibert, Rebecca Dibert, Henry Dibert, Catharine E. Dibert of the Township of Bedford in the County of Bedford, State of Pennsylvania of the first part and Jonathan Dibert of the township of Bedford in the County of Bedford State of Pennsylvania of the second part. Witnesseth that the said parties of the first part for and in consideration of the sum of Four Hundred Dollars lawful money of the United States of America unto them well and truly paid by the said party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted bargained, sold, aliened released, conveyed and confirmed and by these presents do grant, bargain, sell, alien, , enfeoff. release, convey and confirm, unto the said party of the second part, his heirs and assigns.

Diels, thence by land of said Diehl, north thirty two and one half degrees West, eighty-nine perches to three pine witnesses: thence by land of Henry Stiffler north fifty-five degrees east, sixty-one perches to post in field: thence by same north thirty eight and one half degrees West, forty-four perches to White Oak, thence by same north sixty-eight degrees east, twenty-eight perches to chestnut oak Stump, thence by land of Catharine Kegg, south twenty seven and one half degrees East, thirty four perches to stone in field, thence by same north twenty-three and one fourth degrees East, two hundred and sixteen perches to white oak, thence by land of George Dibert South forty-eight degrees East forty-eight perches to post, thence by same south forty-nine degrees East one hundred and seventy seven and one half perches, thence by lands of Jonathan Reighard south fifty-three degrees East one hundred and seventy-four perches to white oak, thence by same North twenty-four and one-fourth degrees West, thirty four perches to a chestnut oak. Thence by same south thirty-nine and one half degrees West twenty-six perches to a chestnut oak, fallen: thence by same south eighteen and one-half degrees East fifty-four perches to part: Thence by same south fifty-three degrees West forty two perches to chestnut oak corner, the place of beginning. It is the intention of the parties to this Indenture, and is understood by the grantee and the grantors, that the said grantors convey by this deed their interest only in what is as their sister Susan�s share of the above described tract of land, said Susan having died intestate and without issue. The grantors still retaining their own shares in the said land excepting those of them who have heretofore conveyed to the grantor herein named.

Together with all and singular, the buildings, improvements, woods, ways, rights, liberties, privileges, hereditaments and appurtenances, to the same belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof and of every part and parcel thereof. And also all the estate right, title, interest, property, possession, claim and demand whatsoever, both in law and equity, of the said party of the first part, of, in , and to the said premises with the appurtenances:
To have and to hold the said premises, with all and singular the appurtenances, unto the said party of the second part, his heirs and assigns to and for the only proper use benefit and behoof of the said party of the second part, his heirs and assigns forever.
