WILL OF JAMES DOYLE


FRANKLIN COUNTY, PENNSYLVANIA WILL BOOK E (p.63); 1844



In the name of God amen. I, James Doyle of Fannet Township, Franklin County, considering the uncertainty of the mortal life and being of sound mind and memory (Blefsed be Almighty God for the same) do make & publish this my last will and testament in manner and form following: (that is to say: First I give & bequeath unto my daughter Eliza Piles all my claim, Interest, or share in the Estate I purchased of Michael Miller Jr. then I will that all my just debts as shall be by me owing at my death, together with my Funeral Expenses, and all charges touching the proveing of or otherwise concerning this my will shall in the first place, out of my personal Estate and effects be fully paid & satisfied and from and after payment thereof & subject thereunto, then I will the remainder of my personal Estate unto my children, James, Mary, William Silvester, Eliza, Margery, Epelina & Dominic and to be equally divided among them - then I will unto my Grandson James Doyle his heirs & afsigns forever a small part of my Freehold Estate or piece of land which is enclosed with a fence around it, with a log House & Stable thereon, adjoining lands of Jacob Eby, said piece or lot of land supposed to contain about Three Acres, the fences & the land whereon said Fences stand on on the East end and South side of said lot or piece of land are not included in said Lot. then I will that the profits of all the remainder of my Freehold Estate for one year shall go towards supporting & schooling my sd. son Dominic. then I will that my two youngest daughters Margery & Eppelina shall draw or receive all the profits of the remainder of my Freehold Estate year & yearly until they have each received to the ammount of Five hundred Dollars. Then I further give and bequeath unto my said son Domini Doyle his heirs and afsigns the one half of all the remainder of my Freehold or real Estate, to hold to him the said Dominic Doyle his heirs & afsigns forever. I further give & bequeath unto my said son Silvester Doyle his heirs - afsigns forever by my said son Sylvester Doyle paying unto my said son William and daughters Mary, Margery and Epelina, each Twenty five Dollars year and yearly for five years. And further my will and meaning is that the said Silvester Doyle's part of the aforesaid Freehold or real estate is to be held or remain bound for the true payment to they aforesaid Legatees for the aforesaid sums mentioned to be paid by him. And lastly I make and ordain Jacob Eby and John Doyle Executors of this my Last Will and Testament, hereby revoking all other or former wills by me made. In witnefs whereof, I have hereunto set my hand and seal the Ninth day of May in the year of Our Lord One thousand Eight hundred and forty four.

Signed, sealed, published & delivered by the above named James Doyle to be his Last Will and Testament in the presence of us, who at his request and in his presence, have subscribed our names as witnefses thereto.

Franklin County, Sct.} 1st Augt. 1844. Personally appeared before me Regr. in & for said county Frederick Stake, Barnabas A. Doyle & John Doyle Jr. the subscribing witnefses to the foregoing Instrument of writing who being duly sworn according to law, did depose & say that they were personally present & saw James Doyle now decd. write his name unto & heard him publish, pronounce & declare the same as & for his Last Will & Testament, & that at the time of the doing thereof the said decd. was of sound & disposing mind, memory & understanding according to the best of their knowledge & belief, & that their names thereto subscribed as witnefses are in their own proper hands writing & done at the same time.

You Jacob Eby do affirm & John Doyle do swear that as Executors of the Last Will & Testament of James Doyle decd. you will well & truly administer the goods & chattels, rights & credits of said decd. according to law, and also "will diligently & faithfully regard & well & truly comply with the provisions of the law, relating to collateral Inheritancy".
