 This is the Last Will and Testament of me William Abnett senior of Maidstone in the County of Kent Bricklayer ffirst I direct that all my just Debts ffuneral and Testamentary expences the Cost of Proving this my Will and other individual charges be duly paid and satisfied and from and after payment thereof I give and devise unto my Trustees and Executors hereinafter named All that my ffreehold Cottage situate lying and being in Stone Street in the said parish of Maidstone and known or distinguished by the number 6 with the yard garden and appurtenances thereto belonging upon Trust that they my said Trustees or the Survivors of them do and shall within a reasonable time after my decease sell dispose of the same either by Public Auction or Private Contract as to them may seem most for so much money as can or may be had or gotten for the same to such person or persons as may be desirous to become the purchaser or purchasers thereof And upon further Trust to stand possessed of the monies arising therefrom and from and after deducting the Expences attendant upon such Sale upon Trust to divide and pay the amount of the Surplus between and amongst my five children Thomas Abnett Mary the wife of James Dann of Linton in the County of Kent gardener Ann the Wife of Charles Cousins of Maidstone aforesaid Gentleman William Abnett and John Abnett in equal shares and proportions share and share alike and to whom I give and bequeath the same accordingly but in case of the death of one or more of them my said Sons and Daughters in my Life time then it is my Will and mind that the share or shares of him her or them so dying should go to and be distributed in equal parts and proportions unto and among all and every the child or children of him her or them so dying that shall be alive at the time of his hers or their decease and if but one then to such only child And I give and bequeath unto my said Trustees and Executors all my Household ffurniture plate linen china ready money Securities for money book Debts personal Estate and Effects of every sort and kind of which I shall die possessed upon Trust to convert the same into money and pay and apply the amount (after payment thereout of all any Just Debts and ffuneral expences as aforesaid) unto and equally between my said Sons and Daughters in like manner in all respects as I have hereinbefore directed of and concerning the Money to arise by the sale of my said ffreehold Cottage And I do declare that the receipt or receipts of my said Trustees and Executors shall be a good and sufficient discharge to any purchaser or purchasers of my said real and personal Estate for so much and such sum or sums as in such receipt or receipts shall be acknowledged to be by them received I give and devise all that my Cottage with the Yard Garden and Appurtenances thereto belonging situate in Stone Street aforesaid and distinguished by the number 1 unto my said son William Abnett his heirs and assigns for ever Also I give and devise all that my Cottage with Yard Garden and Appurtenances thereto belonging situate in Stone Street aforesaid and known by the number 2 unto my said Daughter Ann Cousins to and for her own use and benefit absolutely and with full and free Liberty for her if she shall think proper so to do to sell and dispose of the same either by Deed or Will notwithstanding her Coverture but in case my said daughter shall happen to die without having made any such Sale or disposition Then I give and devise the same unto my said Trustees or the Survivor of them In trust to permit and suffer the said Charles Cousins to receive and take the rents issues and profits thereof for and during the term of his natural life if he shall so long continue a Widower but from and after his decease or second Marriage which ever shall first happen Then I give and devise the said Cottage and premises unto all and every the child or children of my said Daughter Ann Cousins whether Sons and Daughters and as well Sons or Daughters that shall be living at the time of her decease their heirs and assigns for ever to take as tenants in common and not as Joint Tenants Also I give and devise All that my Cottage with the yard garden and appurtenances thereto belonging situate in Stone Street aforesaid and known by the number 3 to my said Daughter Mary Dann to and for her own use and benefit absolutely but with the like free liberty and subject to the same Trust Terms and Conditions in all respects as I have hereinbefore declared of and concerning my said Cottage and Premises devised to my said Daughter Ann Cousins Also I give and devise all that my Cottage with the yard garden and appurtenances thereto belonging situate in Stone Street aforesaid and known by the number 4 unto my said Son Thomas Abnett his heirs and assigns for ever Also I give and devise all that my other Cottage with the yard garden and appurtenances thereto belonging situate in Stone Street aforesaid known by the number 5 and to a certain ffield late in the occupation of Jury and Beattle unto my said Son John Abnett his heirs and assigns for ever but in case of the Death of either of my sons during my life time Then I give and devise the Cottage and premises so given and devised to either of them unto my said Trustees upon Trust to permit and suffer the Widow of him or them so dying and receive the rents issues and profits arising therefrom during the Term of her natural life if she shall so long continue his Widow sole and unmarried from and after her decease or second marriage which shall first happen Then I give and devise the said Cottage and premises unto all and every the child or children of my said Son or Sons so dying as foresaid as well Sons as Daughters as shall be then living their heirs and assigns for ever to take as Tenants in common and not as Joint Tenants And it is my Will and mind that it shall and may be lawful to and for my said Trustees or the survivor of them to repay and reimburse himself and themselves any Loss Costs Charges Damages and expences which he or they may be put to in and about the execution of this my Will or the Trusts hereby in them reposed or in any matter or thing relating thereto And further that they nor either of them shall be answerable or accountable the one for the other of them but each for his own acts Deeds or defaults only nor shall they or either of them be liable for any loss which may occur in or to my said Estate unless the same happen through his or their wilful neglect and I do nominate constitute and appoint my said Son in Law Charles Cousins and my ffriend Joseph Holland of Maidstone aforesaid Gentleman Trustees and Executors of this my Will And hereby revoking and making void all former and other Will and Wills by me at any time heretofore made I do declare this only to be and contain my last Will and Testament In Witness whereof I the said William Abnett the Testator have to this my last Will and Testament contained in these sheets of paper set my hand to the bottom of the two preceeding sheets and to this third and last sheet my hand and Seal this nineteenth day of May in the year of our Lord One Be it known to all men by these presents That I William Abnett of Maidstone in the County of Kent Gentleman have made and declared by last Will and Testament in writing bearing date the Nineteenth day of May One thousand eight hundred and Twenty five I the said William Abnett by this present Codicil do ratify and confirm my said Will and Testament and do further give and bequeath unto my three children Thomas Abnett Mary Dann and Ann Cousins the sum of ffour pounds each of good and lawful money of England to be paid unto them by my Executors out of my Estate and my Will and meaning is that this Codicil be adjudged to be a part and parcel of my last Will and Testament and that all things therein mentioned and contained be faithfully and truly performed and as fully and amply in every respect as if the same were so declared and set down in my last Will and Testament I do hereby further declare that the House being No. 5 shall be for the sole use of my son Thomas Abnett and the House No.4 shall be for the sole use of my son John Abnett notwithstanding what may be set forth in my former Will and Testament Witness my hand this sixth day of October One thousand eight hundred and Twenty eight - William Abnett - signed in the presence of us - Wm Hicknott - Edward Allman - Wm Bettger

Proved at London with a Codicil the 16th April 1830 before the Judge by the Oath of Joseph Holland the surviving Executor to whom Administration was granted having been first sworn by Commission duly to Administer
