ON THE IMPEACHMENT COMPLAINT AGAINST CHIEF JUSTICE DAVIDE
It is not without hesitation that I signed my name on the impeachment complaint against Chief Justice Hilario Davide. This is the same Chief Justice who, at the height of the movement to oust former president Joseph Estrada, I, the then representative of Sanlakas in the 11th Congress, and its officers chose to head the caretaker government which we proposed in lieu of simple constitutional succession. Complaints have been filed regarding the misuse of the Judicial Development Fund (JDF) that we believe should be investigated. Eighty percent (80%) of the JDF are supposed to be allotted for the allowances of court employees yet allegations are that these have not been released while the Supreme Court lavishly spend millions of pesos on renovating the high court's session hall, on summer cottages in Baguio and luxury cars for the justices. Now as the representative of the Partido ng Manggagawa and voice of the working class in the 12th Congress, I deemed it imperative that the rights and welfare of the employees of the judiciary be protected and advanced. However, events have unfolded such that the impeachment case against Davide is not anymore merely legal but is now highly political. The merits of the case on the disbursement of JDF funds have been overshadowed by factional infighting among the elite. Moreover, leaders of small coconut farmers and workers have made representation to us regarding the impeachment case. While they understand our endorsement of the impeachment complaint based on its merits, they utterly believe that Danding Cojuangco backed the impeachment move to further his interests to the detriment of small coconut farmers and workers. The interest of the masses is above all our advocacy and we cannot but side with them against the elite. Thus, I hereby manifest the withdrawal of my signature affixed on the endorsement of the articles of impeachment against Chief Justice Hilario Davide.
