Organization (ILO) Conventions:
The two main ILO
Conventions designed to protect migrant workers are the Migration for
Employment Convention (Revised), 1949, (No. 97) and the Migrant
Workers (Supplementary Provisions) Convention, 1975, (No. 143). These
conventions and the recommendations that supplement them - the latter
go into greater detail:
"It addresses an array
of issues facing migrant workers such as recruitment matters,
information to be made available, contract conditions, medical
examinations, assistance in settling into their new environment,
vocational training, promotion at work, job security, liberty of
movement, and appeal against unjustified termination of employment or
expulsion".
The key provisions of these
conventions aim at ensuring non-discrimination or equality of
opportunity and treatment between migrant and national workers.
Convention No. 97, for example, stipulates that:
"Each Member for which
this Convention is in force undertakes to apply, without
discrimination in respect of nationality, race, religion or sex, to
immigrants lawfully within its territory, treatment no less favourable
than that which it applies to its own nationals" in respect of
matters such as remuneration, hours of work, overtime, etc.
